SMS Terms of Service

1. Applicable Laws and Regulations

When using Ragic's SMS service, Customers are responsible for ensuring compliance with all applicable telecommunications, privacy, anti-spam, and messaging regulations, including but not limited to Taiwan's Personal Data Protection Act, Fraud Crime Hazard Prevention Act, NCC SMS Sender Real-Name Registration requirements, the U.S. Telephone Consumer Protection Act (TCPA), Canada's Anti-Spam Legislation (CASL), the EU General Data Protection Regulation (GDPR), and Twilio's Messaging Policy and CTIA Messaging Principles.

2. Consent, Record Retention, and Opt-Out Requirements

2.1 Consent and Opt-Out

Customers sending marketing SMS messages to international phone numbers must obtain the recipient's prior express consent in a clear, separate, and verifiable manner and must provide a clear opt-out method (for example, "Reply STOP to unsubscribe").

For marketing SMS messages sent to Taiwan mobile numbers, Customers must provide a free and practical opt-out method, such as a customer service phone number or email address, in accordance with Taiwan's Personal Data Protection Act. Because two-way SMS is not supported in Taiwan, SMS replies may not be used as the opt-out method.

Customers must immediately stop sending messages to any recipient who has opted out. Customers are solely responsible for complying with all applicable consent and opt-out requirements.

2.2 STOP Requests

If a recipient replies with an opt-out keyword such as "STOP," Twilio or the applicable carrier may automatically block future messages to that phone number.

Regardless of whether such blocking occurs, Customers may not attempt to send any further marketing messages to a phone number that has opted out. Repeated attempts to send messages to opted-out recipients may trigger Twilio compliance reviews, service suspension, or other enforcement actions. Under certain laws, including the U.S. TCPA, the act of sending a message itself may constitute a violation, regardless of whether the recipient actually receives the message.

Customers are solely responsible for any legal liability, Twilio fines, and service disruptions resulting from violations of this section.

2.3 Lawful Collection of Phone Numbers

Customers must ensure that recipient phone numbers are obtained lawfully and that SMS messages are sent only for purposes consistent with the original collection purpose.

2.4 Prohibited Contact Lists

Customers may not use phone numbers obtained through purchased, rented, exchanged, scraped, or otherwise unlawfully acquired contact lists.

2.5 Record Retention

Customers must maintain records demonstrating the lawful source of recipient phone numbers and, where applicable, proof of consent. Such records must be retained for at least four (4) years following the last SMS sent to the recipient, or for any longer period required by applicable law.

3. Audits and Proof of Consent

3.1 Audit Requests

Upon receiving an email audit request from Ragic, Customers must provide the requested proof of consent for specified recipients within ten (10) business days.

If Twilio, a regulatory authority, or a legal proceeding requires an expedited response, Ragic may shorten this deadline by email notice.

3.2 Failure to Provide Evidence

If a Customer fails to provide the requested evidence within the applicable deadline, Ragic may immediately suspend the Customer's SMS functionality and cooperate with Twilio, regulatory authorities, or legal proceedings as required.

4. Prohibited Content (SHAFT Plus)

Customers may not use the Ragic SMS service to send messages containing or promoting any of the following:

(1) Sexual or adult content;

(2) Hate speech, discriminatory content, or violence;

(3) Alcohol-related promotions;

(4) Weapons, ammunition, or military equipment;

(5) Tobacco products, cannabis, or electronic cigarettes;

(6) Gambling, betting, or lottery-related content;

(7) Illegal or inappropriate financial products or services, including predatory lending, fraudulent loans, or financial services not approved by the competent authorities;

(8) High-risk cryptocurrency promotions or initial coin offerings (ICOs);

(9) Content that infringes upon the rights of others or violates applicable laws;

(10) Content prohibited under Twilio's Messaging Policy or CTIA guidelines; or

(11) Fraudulent messages impersonating government agencies, financial institutions, well-known brands, or any content that may violate applicable anti-fraud laws.

5. Message Content Requirements

5.1 Sender Identification for Taiwan SMS

SMS messages sent to Taiwan mobile numbers must contain the registered sender brand name in the format required by applicable NCC regulations.

5.2 Domain Whitelisting Requirements

For commercial SMS messages sent to Taiwan mobile numbers, including both marketing and transactional messages, any message containing a URL or shortened URL must comply with applicable carrier domain-whitelisting requirements.

5.3 Real-Name Registration and Approval Process

Customers must submit sender registration and domain-whitelisting requests through the designated Ragic application forms.

SMS messages may only be sent after the applicable carrier has approved the registration or whitelist request.

Ragic acts solely as a submission intermediary and does not guarantee approval by any carrier. If approval is not granted, message delivery may fail, and Ragic shall not be responsible for such failures.

5.4 Approved Use Cases

Customers may use the SMS service only for the messaging purposes disclosed during the compliance registration process (i.e., the SMS Type declared in the SMS Service Application Form).

If actual usage exceeds or differs from the declared use case, Ragic may suspend the Customer's SMS functionality pursuant to Section 6, and the Customer shall bear sole responsibility for any resulting legal liability, with no liability attributable to Ragic.

6. Enforcement

6.1 Suspension or Termination

Ragic may suspend, restrict, or terminate a Customer's SMS functionality immediately and without prior notice if:

During a suspension period, Customers may submit additional information, documentation, or explanations as requested by Ragic. Ragic will determine, in its sole discretion, whether service should be restored.

7. Indemnification

Customers shall indemnify and hold harmless Ragic from and against any losses, damages, liabilities, penalties, costs, or expenses arising from the Customer's violation of these Terms or applicable laws, including but not limited to Twilio fines, service suspension costs, legal fees, attorneys' fees, settlement amounts, and other reasonably incurred losses.

Any amounts owed under this section must be paid within thirty (30) days after Ragic provides written notice.

8. Monitoring and Data Processing

Customers acknowledge and agree that, for compliance monitoring and troubleshooting purposes, Ragic may collect and process information including recipient phone numbers, message timestamps, message categories, and delivery or error responses.

Such information will be handled in accordance with Ragic's Privacy Policy.

Updates to These Terms

Last updated: 2026/07/01.

Ragic reserves the right to modify these Terms at any time. Any updates will be communicated through announcements, email, or other reasonable means. Continued use of the SMS service after such updates become effective constitutes acceptance of the revised Terms.
